To ensure you have a safe and pleasant experience, we are committed to adhering to the Consumer Protection Act. As part of this, we inform you of the terms and conditions of your stay in advance so that you are fully aware of them before your arrival. This document constitutes a legally binding agreement between you and Chaplin (Pty) Ltd, and by signing, you acknowledge and agree to its terms.
These terms and conditions apply to all properties managed and/or owned by Chaplin (Pty) Ltd.
Indemnity Form Requirement
As part of our check-in process, you and every adult in your party must read this document prior to arrival, including on behalf of minor children accompanying them. By signing, you acknowledge the terms below and agree to them for you and your party.
Indemnity and Risk Acceptance
Right of Admission Reserved
Right of Admission is reserved. All guests, their family members, visitors, or invitees entering or residing at the premises of any property managed and/or owned by Chaplin (Pty) Ltd do so entirely at their own risk.
Binding of All Parties
It is an express condition of entering, residing, or interacting with Chaplin (Pty) Ltd, its staff, contractors, owners, or agents that all guests, visitors, and invitees will be bound by this indemnity. The person booking agrees to inform all members of their party, including visitors, of these terms, and all such persons will be considered bound by the provisions contained herein.
Indemnity Agreement
You indemnify and hold Chaplin (Pty) Ltd, its agents, employees, contractors, owners, property owners, and partners harmless against any claims, damages, liability, or responsibility for injury, death, loss, or damage to yourself or any other person, including property. This includes any loss of support or earnings (past or future) arising from or connected to your stay, regardless of any act or omission, including negligence, by Chaplin (Pty) Ltd or its representatives.
You also indemnify Chaplin (Pty) Ltd for any claims made on behalf of minor children or other individuals in your care.
Facilities, Activities, and Risk Awareness
You and your party accept that there are inherent risks and dangers associated with using the facilities, accommodation, and participating in activities offered by Chaplin (Pty) Ltd. Examples of such risks may include, but are not limited to, the use of swimming pools, uneven terrain, or stairs.
You warrant that you are in a suitable physical and mental condition for any activities you participate in.
Personal Responsibility
By signing this form, you accept personal liability for all costs related to your stay, including accommodation, goods, and services consumed, ordered, or supplied during your visit.
Guests are also responsible for the actions and behavior of minor children or dependents in their care.
Security and Losses
Whilst Chaplin (Pty) Ltd endeavors to keep its premises secure using top-level security services, it shall not be held liable for any loss, theft, or damage to personal belongings, including but not limited to cash, jewelry, electronic equipment, or vehicles, however caused during the guest’s stay.
Use of Facilities and Special Risks
Chaplin (Pty) Ltd properties may have swimming pools, outdoor areas, or features such as braai/barbecue facilities, all of which are used at the guest's own risk. Swimming pools have no lifeguard on duty, and children must always be supervised by a responsible adult. Guests are responsible for adhering to all fire safety regulations when using outdoor braai/barbecue areas or fireplaces. Any damages resulting from unattended fires or hot coals will be charged to the guest.
Reporting Incidents
Any incidents of injury, damage, theft, or other loss must be immediately reported to Chaplin (Pty) Ltd's management or representatives. Guests are required to complete any forms necessary for the purposes of documenting such incidents.
Warranties and Representations
Chaplin (Pty) Ltd does not express or imply any warranties or guarantees regarding its services and facilities beyond what is stated in these Terms & Conditions. Guests acknowledge that they are not relying on any additional representations, guarantees, or statements unless confirmed in writing.
Compliance with Rules and House Regulations
By reading and accepting these Terms & Conditions, guests and visitors agree to comply with any additional rules and regulations that may apply from time to time, including but not limited to water and electricity conservation measures, recycling protocols, and health and safety regulations.
Terms & Conditions for Your Stay
Cancellations and No-Shows
Cancellations, early departures, or no-shows will incur a charge equivalent to the total cost of the booking.
Accommodation Policies
Accommodation is self-catering unless explicitly stated otherwise.
Child Policy
Guests under the age of 16 are considered children and must be accompanied by an adult at all times.
The safety and supervision of children are the sole responsibility of their accompanying adults.
Children are included in the total guest count.
Check-In, Stay and Check-Out
Check-in is permitted between the hours of 3:00 PM and 9:00 PM and must be conducted using the method provided unless otherwise agreed upon in writing. Guests must vacate the property by 10:00 AM on the day of check-out to allow for cleaning and preparation for the next occupants. Failure to comply with the check-out time may result in additional charges.
During the stay, the maximum occupancy per bedroom is limited to two persons unless expressly stated otherwise in the booking confirmation. Guests are strictly prohibited from sleeping in areas outside of designated bedrooms. Extra guests are not permitted to sleep on couches, sofas, or other non-bedroom areas. Pets are strictly prohibited on the premises. Guests are required to observe quiet hours between 10:00 PM and 8:00 AM to maintain a peaceful environment for all residents and neighbors. The hosting of parties, gatherings, or events is strictly forbidden. Commercial photography or videography is not permitted without prior written consent from the property manager. Smoking is strictly prohibited inside the property and anywhere on the premises.
For the safety and security of all guests, outdoor security cameras have been installed to monitor the main gate, driveway, garage, entrances, walkways, and garden. These measures are in place to ensure the safety of all occupants while respecting privacy.
Before departing the property, guests are required to dispose of all trash in the designated bins. All lights, appliances, and climate control systems must be turned off. Keys must be returned using the method agreed upon in advance. Guests must ensure that all doors and windows are securely locked before leaving the property.
Fines and Penalties
Guests are advised that violations of these terms and conditions, including but not limited to breaking house rules, hosting unauthorized guests, smoking, failing to adhere to check-out procedures, or causing damage to property, may result in fines or penalties. These fines will be used to remedy the violation or cover any associated costs.
These terms are legally binding and are designed to promote safety, security, and respect for all occupants and neighbors. By confirming a booking and staying at the property, guests explicitly agree to adhere to these terms and conditions. Non-compliance may result in additional charges, fines, penalties, or legal action where applicable.
Legal Framework
These Terms & Conditions are governed by South African law. Guests submit to the jurisdiction of South African courts for any disputes.
